Supervisor Nelson called the meeting to order at 7:00 pm. Trustee Kosner led those present in the Pledge of Allegiance.
A motion was made by Trustee Griffith and seconded by Trustee Kosner to have Assessor Tonigan serve as clerk pro tem in the absence of Township Clerk, Priscilla Rose, due to the death of her mother.
Roll call: David Nelson, Supervisor; Don Griffith, Trustee; Dick Kosner, Trustee; Art Rice, Trustee; Roberta Svacha, Trustee.
Also present: Rebecca Tonigan, Assessor; Tim Murray, Township attorney; Dan Cerny, Joy Hoeffler, Janet Agnoletti, Robert Wiltgen, Petronella Wiltgen, Michael Johnson, Kathleen Leitner.
Public Comment
Pat Wiltgen and Bob Wiltgen, 26833 W. Highland Road, Barrington, addressed
the board regarding a flooding problem on their property. She said she has lived
at the address for 42 years and the flooding started the 4thyear at their home.
Through the years they have had to replace carpet 11 times due to the flooding.
Bob Wiltgen stated that the problem is getting progressively worse. They suspect
the problem is due to a broken drain tile that runs between 18thand 19thStreets.
He added that a large tree is in the drainage way that adds to the problem. He
has spoken with the Highway Commissioner and reports that the Commissioner said
that it is not a Township issue. He wants to know who owns the easement that the
tree is on. Mike Johnson, who resides in the same neighborhood, presented an
aerial map of the area. After more discussion, it was suggested that a title
search be performed to determine the owner of the drainage area where the
problem exists.
Trustee Rice gave some history of the area and the current status of the flooding. He suggested that there is a problem, but it needs to be determined if the problem is located on private property or an easement. Once ownership is determined, the responsible party can correct the problem.
Approval of minutes
Motion to accept resignation of Trustee Richard J. Kosner
Supervisor Nelson acknowledged Trustee Kosner’s resignation and thanked
him for his service to the Township. Nelson then presented Resolution for
Recognition of Trustee Richard "Dick" Kosner upon his Retirement.
A motion was made by Trustee Rice and seconded by Trustee Griffith to accept the resignation of Trustee Richard J. Kosner. Motion carried.
Kosner said he appreciates the opportunity to give back to the community and feels the teamwork of the Township has made Cuba Township a special place to live.
Nelson reminded the board that Kosner’s resignation is effective October 31, 2009. Illinois state law provides that Cuba Township has 60 days to replace the vacancy in the office. Nelson said that he has 2 resumes of prospective candidates for the trustee vacancy. He will distribute those to the board.
Intergovernmental Agreement- Village of Tower Lakes/Emergency
Management
Leitner told the board that she has spoken with Lake County officials to try to
have the Village of Tower Lakes Village Hall reinstated as a polling place. She
also feels that the Village Hall would be a good distribution place in the event
of an emergency because the village has its own police force. Medicine to be
distributed will be in pill form, not injectable medicine. The intergovernmental
agreement was discussed. Attorney Murray would like TOIRMA to review the
agreement prior to approval by the Township.
A motion was made by Trustee Griffith and seconded by Trustee Rice to approve the intergovernmental agreement with the Village of Tower Lakes pending approval from TOIRMA.

BACOG- ground water presentation
Janet Agnoletti and Joy Hoeffler presented the second part of their ground
water presentation. Agnoletti explained that the presentation has been changed
since originally presented in July 2009. Various questions from board members
followed the presentation.
Levy discussion
Nelson suggested to the board that a 5% reduction be made in this year’s
General Town levy. Rice asked Nelson to explain the reasons that State
Representative Mark Beaubien was not in favor of a 5% reduction in state
spending as proposed by State Senator Dan Duffy. Nelson explained that the
discussion initially was brought up at a BACOG meeting by Duffy. Duffy’s
suggestion was to reduce state spending across the board by 5% and hopefully
have this practice trickle down to others levels of government in Illinois.
Beaubien’s explanation at that time, Nelson reported, was that he did not feel
all departments at the state level could handle such a reduction. Nelson stated
that he feels this practice should be adopted by the Township. A 5% reduction
would represent approximately $50,000 in the General Town budget. Further
discussion continued regarding various areas of the General Town budget that
could be reduced. Nelson added that the Road District levies and budget are
separate from General Town and should be discussed with Highway Commissioner
Gooch.
A motion was made by Trustee Rice and seconded by Trustee Griffith to table the levy discussion until the November 12, 2009 board meeting. Motion carried.
BACOG report
Nelson reported that the BACOG dinner is November 14, 2009. Any Township
officials that would like to attend should do so at their own expense. Rice
replied that he would possibly attend.
White Memorial Cemetery
Highway Commissioner’s report
Gooch was not in attendance at the meeting but sent a report on disc to each
trustee. A copy of the report is available.
Assessor’s report
Tonigan reported that there have been 525 hearings at the Board of Review.
Approximately half of the hearings are from lawyers representing 2
neighborhoods.
Health insurance review
Griffith suggested that the Township get a quote from a new broker and/or
health insurance carrier this year. He gave Nelson a form from a company that he
was familiar with to handle a new quote. Nelson will give it to Nancy Donati for
completion.
Fall Festival update
Nelson reminded the board that the Fall Festival is Saturday, October 17. He
asked those who are available to help to arrive at 10:00 am. This year residents
will be asked to take only one brat or hot dog per person.
Newsletter update
Tonigan reported, in Rose’s absence, that the next newsletter will be
distributed in January 2010.
Approval of bills
A motion was made by Trustee Svacha and seconded by Trustee Kosner to
approve the bills in the amount of $305,284.30, check nos. 23075 through 23235.

New business
Nelson distributed resumes from 2 candidates for the trustee position- Dan
Cerny and Jack Mumaw.
Discussion reverted back to the budget and Kosner presented his suggestions for changes and/or reductions. He stressed the need for freezing any new initiatives and salaries. There was some discussion about soliciting ads for the newsletter in an effort to reduce costs. Griffith added that he felt the printing costs for the newsletter are too high. Other ideas were discussed for reduction in spending and increased efficiency.
Murray said that he will make a presentation in either November or December regarding upcoming changes to the Freedom of Information Act and Open Meetings Act.
Old Business
Rice told the board that the committee on senior transportation is
continuing to research options. He said there are several busses in the
Barrington area that he feels would like to investigate.
Adjournment
A motion was made by Trustee Kosner and seconded by Trustee Svacha to
adjourn. The meeting was adjourned at 8:20 pm. Motion carried.
